Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Startupbricks Pvt. Ltd. ("Startupbricks", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, you may not access or use our services. These Terms apply to all visitors, users, clients, and others who access or engage our services.

2. Description of Service

Startupbricks is a brand growth agency that provides brand strategy, digital marketing, SEO and content, and AI product building services to startups and growing brands. The Service includes consulting engagements, execution services, and AI-powered product development delivered on a retainer or project basis.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] of any unauthorised use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations, including data protection laws (GDPR, CCPA).
• Send unsolicited bulk messages or spam.
• Scrape, harvest, or collect data from the Service in an unauthorised manner.
• Impersonate any person or entity or misrepresent your affiliation.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorised access to any part of the Service or its related systems.

5. Engagement and Billing

Startupbricks Pvt. Ltd. offers monthly retainer engagements and project-based arrangements. Retainers are billed monthly in advance. A minimum engagement period of 3 months applies to Starter and Growth plans unless otherwise agreed in writing. Invoices are payable within 7 days of issuance via bank transfer, UPI, or other agreed payment methods. Work commences only upon receipt of payment. We offer a 30-day satisfaction guarantee for new clients: if we have not delivered the agreed strategy and execution within the first 30 days, we will refund the first month's fee.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement. Startupbricks Pvt. Ltd. will not disclose client business information, data, or strategies to third parties without prior written consent, except as required by law.

7. Intellectual Property

All deliverables, strategies, content, and work product created by Startupbricks Pvt. Ltd. for clients remain the intellectual property of the respective client upon full payment, unless otherwise agreed in writing. Our brand name, logo, and trademarks may not be used without prior written consent of Startupbricks Pvt. Ltd.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Third-Party Services

The Service may contain links to or integrations with third-party websites or services (e.g., HubSpot, Salesforce, LinkedIn). We are not responsible for the content, practices, or terms of any third-party services. Your use of third-party services is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Startupbricks Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to the services rendered. Our total liability shall not exceed the fees paid by the client in the three months preceding the claim.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
